Decree dignity in the field of trucking
In recent months there has been much talk of the famous Decree Dignity, because it was the first measure approved by the newly established Conte Government and had the goal of bringing new measures for companies and workers. In particular, as regards the road haulage sector, the innovations introduced concerned the renewal of work contracts; in fact, the positive news regards the maximum duration of fixed-term contracts, which is reduced from 36 to 24 months, even in the case of employment contracts that have as their object the administration through staff recruitment agencies, while the extensions were limited from a maximum number of 5 renewals to 4, for the purpose of hiring permanent employees.
Decree n. 87 of 12 July 2018, called journalistically "Decreto Dignitą", because it contains urgent provisions on the dignity of workers, has restored the so-called causals, that is to renew or stipulate a new term contract you must specify the reason why it is stipulated or renew that contract. The law says that it must be justified by specific reasons of a technical, productive and organizational nature and if these reasons are not there, then it is not possible to employ a greater number of temporary workers.
In essence, the effects of this decree on the road haulage sector is minimal, because already the national collective agreement Logistics, Freight Transport and Shipping provides this possibility to employ more fixed-term workers, which however must not exceed the 35% threshold, when the limit normally set by law is 20%, but as stated above, there must be reasons of a productive and organizational nature.
